Immunity and Accountability

Berge v. School Committee of Gloucester

Brief Details

Current Court
1st U.S. Circuit Court of Appeals

IJ submitted an amicus brief on its behalf and on behalf of the Foundation for Individual Rights and Express in a lawsuit before the 1st U.S. Circuit Court of Appeals. The case seeks to overturn a lower court’s ruling that shielded school administrators in Gloucester, Massachusetts, from accountability after they threatened a parent with legal action for recording and posting his public interaction with the school superintendent’s office.

The First Circuit ultimately sided with plaintiff and IJ, holding that the school administrators' actions were unconstitutional.
