It’s been 100 years since, in Village of Euclid v. Ambler Realty Co., the Supreme Court allowed cities to adopt zoning codes, telling people what they can do on their own property. And it’s been 98 years since the Supreme Court told the city of Cambridge that it nevertheless went too far in restricting what an owner could do with its land. That case, Nectow v. City of Cambridge, was the last time the Court said a zoning law was unconstitutional because the zoning didn’t make sense. Yet, more recently Cambridge has made strides in reforming its zoning, in conjunction with the ongoing YIMBY movement. And some courts seem more suspicious of zoning recently.
