Today, the Partnership for Educational Choice, a joint project of EdChoice and the Institute for Justice, announced that it will immediately appeal an order issued yesterday temporarily enjoining Wyoming’s Education Savings Account (ESA) program. The injunction, issued by the First Judicial District Court of Wyoming, was requested by the Wyoming Education Association, a public education union that seeks to limit educational choice programs in the state.
The ESA program, originally created in 2024 and expanded in 2025, provides Wyoming families with a flexible savings account that may be used to pay for tuition, tutoring, curriculum, therapies, and other qualified educational expenses. With the injunction, the program is now temporarily on hold, depriving Wyoming families of the chance to provide much-needed educational opportunity for their children. The Partnership for Educational Choice will quickly appeal the injunction order. It will also immediately seek a stay of the order, so that families can access the ESA program while the appeal proceeds.
“The court’s decision to limit educational opportunity for Wyoming families is contrary to the Wyoming Constitution,” said Thomas M. Fisher, Executive Vice President and Director of Litigation at EdChoice Legal Advocates, EdChoice’s legal arm. “We will seek to stay the injunction and appeal it as soon as possible.”
