The Institute for Justice sent a letter to Ogunquit officials warning that code enforcement actions against a family’s rooster yard decorations were a violation of their First Amendment rights.
Ogunquit claims the metal roosters are illegal signs that advertise the family’s restaurant. The town, however, has taken no actions against similar roosters placed in the yards of other families in town. That makes their actions a textbook content-based speech restriction.
